Michigan PTO laws: vacation, earned sick time and payout
Michigan PTO laws leave vacation benefits and payout to the written policy, while the Earned Sick Time Act creates separate paid-leave rights. The key size boundary is 10 or fewer employees versus larger employers. Annual sick-time use limits differ from the amount employees earn.

Michigan PTO rules at a glance¶
| Question | Rule and primary source |
|---|---|
| Paid vacation required? | No; company vacation is a policy-based fringe benefit. |
| Sick-time accrual / annual use | 1 hour per 30 worked; use may be limited to 40 hours at a qualifying small business, 72 elsewhere. |
| Small-business boundary | 10 or fewer employees; 11+ for 20 workweeks triggers the larger category under the agency test. |
| Vacation payout required? | According to the written payout promise; no statutory payout if the policy is silent. |
| Use-it-or-lose-it allowed? | Vacation follows the written policy; ESTA carryover has separate protections. |
| Final paycheck deadline | Ordinary wages: regular payday for the separation period; fringe-benefit timing can follow different written terms. |
Is paid vacation required in Michigan?¶
Michigan does not require a paid vacation benefit. Vacation pay is a fringe benefit administered under the employer's written contract or policy. If the policy promises a separation payout on stated terms, those terms matter; a silent policy does not create a statutory cash-out right. LEO fringe-benefit guidance.
Write the earning and payout rules together. Your office manager should be able to read the policy, reconcile the vacation balance and explain the result without guessing what happened for the last employee who left.
Paid sick leave in Michigan¶
Michigan's Earned Sick Time Act generally requires covered employees to earn one paid sick hour per 30 hours worked. Employers may limit annual use to 40 hours at a qualifying small business or 72 hours elsewhere. These use limits are different from annual accrual. Official ESTA text.
The amended law took effect February 21, 2025; the ordinary small-business start was October 1, 2025. Certain newer small employers have a three-year delayed start measured from their first employee. Check that date and any agreement-based transition before applying a standard setup. LEO ESTA overview; current FAQ.
| Employer category | Annual use limit permitted | Accrual-method carryover |
|---|---|---|
| Small business: 10 or fewer, subject to the workforce-history test | 40 paid hours | Up to 40 unused hours |
| Other covered employer | 72 paid hours | Up to 72 unused hours |
Source: current LEO FAQ. Count the employer's employees nationwide, including part-time and temporary workers. Reaching 11 employees for 20 workweeks in the current or prior calendar year changes the classification.
An eligible employee who actually works 1,800 hours earns 1,800 ÷ 30 = 60 sick hours. A qualifying small employer's 40-hour annual use limit does not turn the accrual calculation into 40. LEO's accrual explanation.
Most employees working in Michigan are covered, including part-time and salaried employees; federal workers, certain youth workers, unpaid interns and specified self-scheduling workers are exempt. LEO coverage guidance.
Qualifying front-loading can remove carryover and accrual-tracking duties; part-time grants have additional conditions. Covered uses include illness, preventive care, family care, specified violence-related needs and certain closures. Official ESTA text. Local governments cannot impose their own employee-leave mandates under MCL 123.1388.
Final pay and unused PTO payout at separation¶
Michigan requires vacation payout according to the written policy or contract, rather than an automatic cash-out of every unused balance. Ordinary final wages generally are due on the regular payday for the separation period. An owed fringe benefit can have different written payment terms. LEO benefit guidance; rules 408.9005 and 408.9007.
Read any payout conditions before deciding what is owed. Give payroll the policy version, leave category and reconciled balance. Use the Free PTO payout calculator for arithmetic after establishing the payment obligation.
ESTA itself does not require payment of unused sick time at separation, though a company promise can matter. LEO's ESTA FAQ. Record the sick balance even when no payment is due, because rehire rules need a separate review.
Use-it-or-lose-it and accrual caps¶
State the vacation carryover and expiry terms in writing, and administer the benefit according to those terms. Michigan's policy-based vacation rules are separate from ESTA's statutory carryover protections. An annual vacation reset should therefore never be copied onto the sick bank without review. LEO wage-and-benefit guidance; ESTA text.
Label the controls accurately. Annual use limits regulate time taken. Carryover limits regulate year-end transfer. An accrual ceiling stops earning. Test each control separately in your balance process instead of using one “cap” field for all three decisions.
Other leave small employers should know¶
| Leave | Paid? | Who is covered / key condition | Primary source |
|---|---|---|---|
| Jury service | No general state employer-pay duty | Summoned employees; anti-retaliation protection and notice matter | Official Michigan court jury information |
| Crime-victim court attendance | Protection does not itself create an employer-pay entitlement | Qualifying victims and representatives attending required proceedings | Michigan courts' rights guide |
| Federal family/medical leave | Generally unpaid, job-protected | Covered private employers generally have 50+ employees; individual eligibility tests apply | DOL FMLA fact sheet |
| Military service | Pay depends on applicable benefit rules; reemployment protections apply | Qualifying uniformed service; notice and return requirements | DOL USERRA guide |
What this means for your PTO policy¶
- Confirm employer size, workforce history and applicable ESTA start date.
- Separate annual sick-time use and carryover from ongoing earning.
- State the grant/accrual method and any permitted new-hire waiting period.
- Keep ordinary vacation payout conditions in writing.
- Use the Free PTO policy generator, then review Michigan's state-specific considerations and current agency guidance.
Assign one owner to reconcile the sick bank after payroll and another to review unusual requests. For a very small team, these may be the same person; naming the job still prevents a missed handoff.
Track separate banks in Slack or Microsoft Teams¶
Cabana supports separate leave types and balances, with accrual methods and carryover rules you configure. Employees request leave and check balances through PTO tracking in Slack or PTO tracking in Microsoft Teams. Managers approve from the message.
Use PTO tracking software for small teams to keep requests and balance history together. Review How PTO carryover rules work before selecting year-end behavior.
Frequently asked questions¶
Does an exactly-ten-employee company owe the larger sick allowance?¶
Not solely because it has ten employees: the small-business definition includes ten or fewer, subject to the workforce-history test. Check the employer's wider headcount and prior periods before assigning the smaller category. An establishment's current local staff count is not the whole test. LEO ESTA FAQ.
Do the annual use limits stop employees earning more sick time?¶
No: a permitted annual use limit is distinct from accrual on hours worked. Keep those measures separate so the employee's earned balance is not reduced to the use-limit figure. Review the carryover rule when the benefit year ends. Official ESTA text distinguishes earning, use and carryover.
Can a qualifying front-loaded sick bank avoid carryover?¶
Yes, the amended act provides a qualifying front-loading alternative without the accrual-method carryover duty. Review the full grant and access conditions, particularly for part-time employees, before selecting it. Keep the grant method in the written policy so the year-end treatment has a clear explanation. Official ESTA text.
Does a silent vacation policy require payout?¶
No: LEO says a company is not legally obligated to pay unused vacation when the written policy does not address payout. Review any separate contract and the benefit's actual terms before finalizing the decision. Preserve those terms with the balance calculation for a consistent record. LEO fringe-benefit FAQ.
Can new hires be made to wait before using sick time?¶
Under the accrual method, qualifying employees hired on or after February 21, 2025 may wait up to 120 calendar days before using earned sick time. Review hire date and grant method before applying that delay. Accruing time and being eligible to use it are different questions. LEO ESTA FAQ.
Are final wages due immediately when someone leaves?¶
Ordinary final wages generally are due on the regular payday for the separation period. Owed fringe benefits can follow different written timing; hand-harvest employees have a special wage rule. Give payroll the classification and written benefit terms before assuming one deadline answers every payment question. Michigan administrative rules.
